- Pet Genetics Lab ("PGL") will provide testing services as described on our website and in accordance with the terms and conditions described below. This constitutes a legally binding agreement between the customer and PGL.
- These Terms and Conditions, including any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of the Isle of Man. Customers agree that the courts of the Isle of Man shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions.
- Customers will return all swabs for testing within six months of purchase. If the customer returns the swab for testing after this time we reserve the right to charge the difference in price if prices have increased. If the customer refuses to pay the increased price for testing then a refund will be arranged for the original price paid minus the cost of any used swabbing kits.
- Customers will pay in advance using our online payment system. The only exception to this is where a contract has been signed in advance, in which case PGL will issue an invoice at the point of testing. Invoices shall be paid within 30 days of issue.
- PGL will store and process all samples sent by the customer and retains the right to dispose of the sample remnants or utilise these for research. We will perform all testing and store all samples to the highest standard and all samples become the sole property of PGL.
- The customer has the responsibility to ensure that they have the legal right to submit a sample from the animal in question. The customer has the responsibility to provide accurate information at the time of purchase. Where inaccurate information has been submitted by the customer, PGL will endeavour to correct it, however, we reserve the right to charge an administration fee for corrections.
- The customer accepts responsibility to provide a sample for the named animal. Any inaccuracies resulting from a failure in this respect are not the responsibility of PGL.
- The customer has the responsibility to ensure that they meet the requirements of any breed society or third party, for example having the sample taken and verified by a veterinary surgeon.
- The customer will not submit samples from animals known or suspected to be carrying an infectious disease.
- It is the responsibility of the customer to ensure that results reported by PGL are accepted by their selected Kennel Club or Breed Club, or any other organisation.
- The customer must notify PGL within two months of the test report being issued of any non-conformance. Failure to notify within this time means that the test result has been accepted.
- The customer agrees to keep any apparent discrepancy confidential until the dispute has been resolved. This includes posts to social media (twitter, facebook groups, instagram etc).
- The customer accepts that we only accept test certificates from the following independent laboratories for use in disputes: Animal DNA Diagnostics, the Animal Health Trust, Laboklin and the Kennel Club's CombiBreed test. An investigation will then be carried out an a proportional refund considered based on the results of further testing. All certificates used for disputes must show the microchip number of the animal in question, having been checked and verified by a veterinary surgeon.
- The customer accepts that refunds will not be issued once DNA testing has commenced. After that time, refunds or partial refunds will only be considered if the customer disputes the test result for a specific mutation and can provide a test certificate from one of the laboratories listed in clause 11 as part of that dispute.
- The customer accepts that any retest offered where a new swab is required may be subject to a DNA profile check to verify the same dog is being retested.
- PGL agrees to supply testing in accordance with industry accepted standards and that the testing is carried out by suitably qualified and trained scientists.
- The customer accepts that any test performed is limited to the specific mutation described for that test and that there may be other mutations present in a particular gene, as yet undiscovered, which could cause the same or similar disease, and which are not covered in the current testing protocol.
- PGL does not guarantee that any test result will be issued within a specific timeframe. The suggested turnaround times are provided for guidance only.
- The customer accepts that test results will only be issued to the person who ordered the test.
- We reserve the right to not respond to communications which we consider to be abusive. We have a zero-tolerance police with regards to abuse of our staff.
- We reserve the right to put online test certificates on hold when evidence has been provided to us that the certificate has been used for the purposes of fraud, or if we are provided with evidence that the certificate has been amended by the customer after issue.
- All customer data will be stored securely and with adherence to the General Data Protection Regulation.
- Should PGL not be able to fulfil its role under this agreement as a result of an act, event, or omission beyond the reasonable control of PGL, reasonable efforts shall be made to overcome the event. However, PGL will not be held liable for any delay or expense incurred to the customer.
